Don’t let the cops take your blood for DUI.

In Kentucky, a blood draw has been recognized as an invasive search that is protected against by the Fourth Amendment of the U.S. Constitution for many years now.

You don’t have to give your blood, and you don’t have to consent to a blood draw without a warrant. Though the cops may tell you your license will be suspended at arraignment if you refuse, your license is going to get suspended at arraignment anyway because it’s a DUI case. Don’t fall for it!

Be clear, be confident! “I don’t like needles, I’m sorry. Is there any way I could do a breath or urine test instead?” The cops may get lazy at that point and not test you at all, which will really help your case!
