You can have a jury trial if someone is forcing rehab on you.
Many believe Casey’s Law isn’t really a criminal case. The Supreme Court of Kentucky says otherwise. Forcing someone to go to rehab is a loss of liberty just like going to jail, and threatening someone to go to jail if they don’t go to rehab is a coercion that makes it a criminal case.
Under Casey’s Law, they not only have to prove to 12 people you are an addict, but that your addiction is immediately threatening your life. That is a high bar. Make them work for it if you don’t want to go to rehab. You are an adult and no one should be able to use the courts to make you do something you don’t want to do for that long unless they prove beyond a reasonable doubt your life is at stake.
Talk to your loved one first if they are upset with you about your addiction and you want to stay in their life. However, if you are living on your own and you are over 18 years old, what you do is none of their business!
